When you own a property, you own both the deed and the title. In real estate, to hold a title means you have ownership and a right to use the property. A property deed is a legal document that transfers property ownership from a seller/grantor to a buyer/grantee. A deed contains the legal description of the property (including property lines) and denotes the seller/grantor and the buyer/grantee. It shows who you bought your house from, and when you sell it, it shows those to whom you sold it. Both parties must sign the document to make it official.

What are the elements of a deed?

    4. Signatures: The grantor must sign the deed, and in some cases, the grantee may also be required to sign.
    5. Delivery and Acceptance: The deed must be delivered and accepted by the grantee to be valid.
    6. Notary Acknowledgment: A notary public may be required to witness the signing of the deed and provide a notarization.
    7. Legal Language: A property deed typically includes legal language that specifies the type of deed being used, any restrictions or covenants on the property, and any warranties or guarantees provided by the grantor.

    These are the most common elements found in a property deed, but the specific requirements can vary by jurisdiction and the type of deed being used.

Who holds the deed to my house?

When you purchase a house with a mortgage, the lender has the rights to that property until the loan or debt is paid. If you buy a house without a mortgage, the real estate attorney or title company records the deed and issues a copy to you.
